PetHack 2020 Terms and Conditions
In order to participate in the PetHack 2020, Participants must read and agree to these Terms and Conditions.
Participation

Participants agree to take part in PetHack in an open and respectful manner and agree to comply with the PetRescue’s Code of Conduct (see bottom of page).

Teams must consist of a minimum of three members and a maximum of four members. Exceptions can be made on a case by case basis as decided by PetRescue.

Participation at PetHack is subjected on a “per-team” basis, meaning you are not allowed to be a part of more than one team at each event.

Changes to team members must be discussed with PetRescue as there is a waitlist of participants to fill these positions.
Confidentiality

As part of PetHack, we may provide you with information which is commercially sensitive & confidential to PetRescue (eg; if the presentation contains information about a real life issue or scenario). You must not disclose any information deemed to be confidential to people who are not also participating in the Hackathon.

The one receiving the Confidential Information must use a reasonable degree of care to protect it and to prevent its unauthorized use or disclosure.

You must only use that confidential information to develop your entry as part of PetHack. Outside PetHack, you agree to keep that information confidential & not use or disclose it without our prior written consent. Your obligation of confidentiality continues in perpetuity: it survives any disqualification from PetHack and the Hackathon duration.

Confidential Information does not include information that: (a) was known to the one who received it before it was disclosed; (b) is publicly available; (c) was rightfully received from a third party without a duty of confidentiality; or (d) was independently developed by the recipient.

Unless otherwise agreed in writing, the duty to protect Confidential Information expires five years from disclosure.
Photography and Video
Participants acknowledge that PetRescue and sponsors of PetHack will be recording the PetHack events on video, photographs, audio recording and other media, and therefore agree that PetRescue has the unrestricted right to use any of images, recordings and other media in materials produced during or after the Hackathon.
Code and Data

You agree to only include code, data, or other materials in a submission for the Hackathon that you have the right to use and release consistent with these rules. All code and data must be available under an appropriately open license that allows reuse, commercial use, remixing and redistribution.

Use of third party tools and APIs under open use license is allowed. If you use such a tool or API in your submission try you must note and take responsibility for adhering to the third-party terms of service.

The reason for the open licensing of code and content is because the Hackathon is about awesome outcomes that anyone can use and build on.
Ownership of Intellectual Property
By participating in PetHack, you agree to the following:

Participant represents and warrants that, to the best of his or her knowledge, any work product is Participant’s own original work, was not developed in any form prior to the event, and is not within the intellectual property rights of any third party, including any former or current employers. If you are unsure, you should consult any former or current employment agreement to which you are a party. Under no circumstances will PetRescue be liable to you or any third party for any damages, direct or otherwise, arising out of the use of this hackathon work product.

As of the date of this event, and in consideration of PetRescue sponsoring this event and facilitating your participation, you grant to us joint right, title, and interest in any intellectual property (such as inventions, copyrightable materials, trademarks) that you created, conceived, and/or recorded as part of your Hackathon entry.

Each team may choose to progress with their ideas independently or whatever ideas are created may be further developed by PetRescue. All IP generated is both jointly and severally owned by the relevant participants and also by PetRescue and either party may commercialise such concepts or ideas without having any regard to the other party.
Presentation Submission
Big Ideas Session

Submissions close at midnight (AWST) on Friday 11th September to allow for any technical difficulties and fair flexibility for the teams to be able to submit by the same deadline.

Any submissions received after this date will not be eligible for judging.

Participating teams will be able to view all of the submissions as they come through.
Weekend Hackathon

Submissions close at midnight (AWST) on Sunday 13th September to allow for any technical difficulties and fair flexibility for the teams to be able to submit by the same deadline.

Participating teams will be able to view all of the submissions.
All submission elements must be completed by the required time. No requests for extensions will be considered.
Judging
-
All PetHack entries will be scored by the PetHack Judging Panel against the same consistent criteria used by all judges.

The PetHack Judging Panel, consisting of a mix of PetRescue representatives and industry supporters, will choose all winners.

The PetHack Judging Panel’s decision is final. No correspondence will be entered into. This is a competition of skill. Chance plays no part in this competition.

Judging for the Big Ideas Hack session will be conducted during the weekend of Saturday 12th and Sunday 13th. Winning ideas will be announced during the following week.

Notification of Prize Recipients and Recipients’ Obligations

Participants will be notified of their selection as a winner via email to their Hackathon registered email address and/or team Slack channel.

Each winning team must nominate a team leader. This person will be required to liaise with PetRescue and provide an acceptance speech during the live award announcements.

The team leader will make the final nomination for distribution of the prize donation to their selected rescue organisation, chosen from a shortlist provided by PetRescue.

Winners agree to participate in any media or promotional activity regarding PetHack and grant to PetRescue a worldwide, irrevocable, sub-licensable, and non-exclusive licence to use Participant’s name, image and likeness for advertising and promotional purposes.
Liability & warranties

To the extent permitted by law, the Hackathon, support and associated services are provided on an “as is” basis, without any warranties, express or implied. Neither we nor our affiliates make any representation about the completeness, security, reliability, quality, or availability of PetHack.

To the extent permitted by law, neither PetRescue nor supporters will be liable for damages of any kind (including under contract, tort or negligence), arising out of or in connection with the Hackathon, including any direct, indirect, special, incidental, consequential or punitive damages (including personal injury, emotional distress, loss of revenue or profits loss of use or goodwill, loss of data), even if such loss was foreseeable (loss). You participate in PetHack & engage with PetRescue, supporters, and other participants and attendees, at your own risk.
Privacy
PetRescue will deal with all personally identifying information you provide us in accordance with our Privacy Policy. In addition to collecting, storing & using your personal information in accordance with our Privacy Policy, when you register to participate in PetHack we will also subscribe you to receive our communications relating to this event and potential future Hackathon events. You can opt-out of these by emailing us and asking to be removed or unsubscribed.
