Qld woman loses damages bid

A Queensland woman accused of neglecting more than 100 dogs has lost her bid to sue the RSPCA and the State Government for damages.

The RSPCA seized more than 100 poodles from Geraldine Robertson's unlicensed kennel at her Waterford property south of Brisbane last year.

She filed a damages claim in the Supreme Court alleging misconduct by RSPCA officers and the State Government.

The case was struck out and she appealed.

The RSPCA and the Government sought to have the appeal struck out.

In a unanimous decision the Court of Appeal decided to do so - and ordered Mrs Robertson to pay the legal costs of the RSPCA and the Government.

Mrs Robertson has also been ordered to pay the legal costs of the RSPCA and the Government.

Legal action is still pending to determine the fate of the poodles.
